Terms of Service

Effective August 24, 2026

These terms cover your use of brocan.co and of the products Brocan designs, builds, and runs: BitList (web and iOS) and Faded (iOS, in development). By using our website or products, you agree to them.

Your account

Some products require an account. You are responsible for keeping your credentials safe and for what happens under your account. You must be at least 13 years old to create one.

Your content

Content you create in our products — lists, items, files, anything else — stays yours. You give us only the limited license we need to store it, sync it across your devices, and show it to the people you choose to share it with.

Acceptable use

Do not use our products to break the law, to infringe on other people's rights, to distribute malware or spam, or to attempt to disrupt or gain unauthorized access to our systems. We may suspend or close accounts that do.

Subscriptions

Some products offer paid plans. Purchases made on iOS go through Apple's App Store and follow Apple's billing and refund terms. Prices and plan limits are described in the product and may change with notice.

Availability and changes

We work hard to keep our products fast and reliable, but they are provided "as is", without warranties of any kind. We may add, change, or retire features; if we ever discontinue a product, we will give you reasonable notice and a way to export your content.

Limitation of liability

To the maximum extent permitted by law, Brocan is not liable for indirect, incidental, or consequential damages arising from your use of our website or products, and our total liability is limited to the amount you paid us in the twelve months before the claim.

Governing law

These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules.

Changes to these terms

If these terms change in a meaningful way, we will update this page and the effective date above. Continuing to use the products after a change means you accept the new terms.
